Facts

Aidacare is an NDIS and healthcare equipment supplier. It used unfair contract terms and told customers with faulty products that they had no right to a remedy, despite the consumer guarantees.

Outcome

The ACCC accepted a court-enforceable undertaking under section 87B of the Competition and Consumer Act 2010 (19 March 2026). Terms include: Refunds to consumers who reported faulty products Jan 2022 to May 2025; website corrective notice; Level 3 compliance program; remove unfair terms. An undertaking is not a finding or admission of a contravention unless the regulator says the party admitted it.
