ADM transparency lands 10 December 2026 — small-business exemption removal is still only a proposal

Automated decision-making transparency applies from 10 December 2026, and the OAIC must register the Children's Online Privacy Code by that date (its commencement is not yet fixed). Removing the small business exemption — which would make ~2 million SMBs APP entities — is agreed in principle for a future tranche but not yet law, with no date set. Most SMBs don't have a privacy policy, NDB plan, or training in place.

AML Tranche 2: real estate, accounting, law become AUSTRAC reporting entities

Since 1 July 2026, tens of thousands of professional service firms have been AUSTRAC reporting entities. Each day a firm provides a designated service unenrolled can be a separate contravention, with infringement notices of $21,840 (company) per contravention and civil penalties of up to $36.4M (body corporate) maximum per contravention. AUSTRAC began issuing notices to unenrolled firms on 28 August 2026.
