Facts

Sea Swift supplies sea freight to remote NT and Far North Queensland communities. From September 2022 to May 2025 it put multi-year exclusivity clauses and match-right terms in customer contracts, which kept customers from using rival carriers.

Outcome

The ACCC accepted a court-enforceable undertaking under section 87B of the Competition and Consumer Act 2010 (11 June 2026). Terms include: Remove exclusivity and match-right terms; cap standard contract terms at 2 years; notify customers; compliance program; 3 years. An undertaking is not a finding or admission of a contravention unless the regulator says the party admitted it.
