EnergyAustralia Pty Ltd: ACCC section 87B undertaking

enforceable undertaking3 Aug 2026

Respondent

EnergyAustralia Pty Ltd

Facts

Residential retailers had to have a Solar Sharer Offer (a standing offer that includes a free-usage window) available by 1 July 2026. EnergyAustralia told the ACCC in late June that it would miss that date and only offered it from 3 August 2026.

Outcome

The ACCC accepted a court-enforceable undertaking under section 87B of the Competition and Consumer Act 2010 (3 August 2026). Terms include: Keep offering the Solar Sharer Offer and report to the ACCC and AER. An undertaking is not a finding or admission of a contravention unless the regulator says the party admitted it.
