REA Group Ltd and realestate.com.au Pty Ltd: ACCC section 87B undertaking

enforceable undertaking11 Sept 2026

Respondent

REA Group Ltd and realestate.com.au Pty Ltd

Facts

REA's subscription, depth and sponsorship contracts pushed agencies to list all or most of their properties on realestate.com.au, or to buy premium listing tiers. The ACCC was concerned this may have stopped rival listing portals from competing meaningfully.

Outcome

The ACCC accepted a court-enforceable undertaking under section 87B of the Competition and Consumer Act 2010 (11 September 2026). Terms include: Stop enforcing all-or-majority listing exclusivity and tier-linked sponsorship terms; let agencies downgrade at least 25% of eligible sale listings; re-engage with ACCC after 24 months; compliance program; 3 years. An undertaking is not a finding or admission of a contravention unless the regulator says the party admitted it.
