ASIC v Macquarie Investment Management Limited (declarations)
Respondent
Macquarie Investment Management Limited
Facts
As superannuation trustee and wrap-platform operator, MIML did not put Shield Master Fund options on a watch list for closer monitoring. About 3,000 members invested around $321 million in Shield in 2022–23. Declarations were made on agreed facts and admissions.
Outcome
The Federal Court made declarations that Macquarie Investment Management Limited contravened the Corporations Act (20 March 2026). ASIC did not seek a pecuniary penalty. Declarations of contravention; under an earlier court enforceable undertaking (25-215MR), about $321 million was paid to some 3,000 Shield investors.
