enforceable undertaking3 Mar 2026

Respondent

Uniting Communities Incorporated

Facts

The SA community services provider's payroll misapplied its enterprise agreements and missed annual wage increases from 2015 to 2025. It self-reported in May 2023.

Outcome

Fair Work Ombudsman accepted an enforceable undertaking (3 March 2026). Terms include: >$2.6M back-pay to ~1,483 staff; at least two independent audits at own cost; staff training; hotline and complaints mechanism; audit committee monitoring with reporting to FWO. An undertaking is not a finding or admission of a contravention unless the regulator says the party admitted it.
