The Smith Family: Fair Work Ombudsman enforceable undertaking
enforceable undertaking12 June 2026
Respondent
The Smith Family
Facts
The national charity lacked systems to identify which award or agreement covered staff and misclassified some, underpaying minimum rates and other entitlements from 2016 to 2024. It also failed to keep proper records.
Outcome
Fair Work Ombudsman accepted an enforceable undertaking (12 June 2026). Terms include: $5.912M paid to 784 staff; independent audit; internal employee forum on pay; six-monthly reports to FWO; automated time-and-attendance system. An undertaking is not a finding or admission of a contravention unless the regulator says the party admitted it.
