UCT (Unfair Contract Terms)

Regime under the ACL + ASIC Act prohibiting unfair terms in standard form contracts.

From 9 November 2023, the UCT regime carries pecuniary penalties — under the ACL, for a body corporate the greater of $100M, 3× benefit or 30% of adjusted turnover per unfair term for contraventions from 28 March 2026 (earlier conduct: $50M limb). Applies to standard form contracts with consumers and small businesses (<100 employees or <$10M turnover). Each unfair term can be a separate contravention.
